Pennsylvania Vaccine Injury Lawyer

Widman Law Firm is able to file claims for vaccine related injuries transpiring in the State of Pennsylvania. The admission required to bring vaccine injury claims in front of the Court of Federal Claims, also known as the “Vaccine Court,” is a federal admission. Phyllis Widman, Esq. is thereby admitted and prepared to bring your vaccine injury claims in all 50 states and D.C., including Pennsylvania. Our office is also located nearby in the neighboring state of New Jersey.

The Court of Federal Claims was created in 1986 as part of the National Childhood Vaccine Injury Act (NCVIA). In response to numerous lawsuits seeking compensation for injuries that children were suffering from vaccinations, Congress created this Act to both shield manufacturers and administrators from liability while providing a more streamlined process for victims seeking compensation for their vaccine injuries. Instead of challenging manufacturers, the adversary in the Court of Federal Claims is always the Department of Health and Human Services (HHS), a government entity. While the initiation of Vaccine Court was based on reports of injuries to children, the Vaccine Court now hears at least equal, if not more, cases stemming from adult injuries.

The Vaccine Court is designed to be a no-fault program, whereby if your injury meets the Vaccine Injury Table requirements, you have a valid claim. Such “table injuries” include encephalopathy or encephalitis, anaphylaxis, shoulder injuries, and vasovagal syncope. In order to qualify as a “table injury,’” the injury must have occurred (1) in response to a vaccine for which that specific injury is listed as a known reaction and (2) within the time frame provided on the table. While table injuries provide for a much more streamlined process, even if your injury does not fall into the no-fault scheme, you may still have an “off-table” claim.

The Vaccine Court operates almost entirely remotely. Therefore, the vast majority of cases are completed without ever having to appear in court, making the process accessible to individuals all over Pennsylvania and the rest of the country. Whether you are in Philadelphia, Pittsburg, Lancaster, Harrisburg, Allentown, Scranton, Reading, Erie, Bethlehem, or anywhere in between, the attorneys at Widman Law Firm are prepared to provide you with high quality legal representation for your vaccine injury claim.

Through her years of experience in the Vaccine Court, Ms. Widman has developed an amazing network of experts with whom she works with regularly to fight for compensation for those injured by vaccines. The financial and emotional burdens on the victims of vaccine injuries and their loved ones can be tremendous. Having a strong attorney to help navigate this special court is extremely helpful during these times. "Phyllis Widman, and staff, after years of continuous working on my behalf, keeping in touch with me every step of the way, for years, was happy to inform me that we had won the case. "I hired Phyllis Widman to assist me with the denial of my religious exemption for the COVID vaccine and employment termination by my employer. Phyllis was extremely knowledgeable and clearly explained to me about my legal rights and the legal process. I found her to be very efficient, organized, and passionate about her work and I especially liked that she really cared about me as a person and truly wanted what was best for me. I am very grateful to say, I did have a successful outcome. The religious exemption denial was overturned and I am back to work. I highly recommend Phyllis Widman." Kimberly R.

"Phyllis and her team took care of everything after my injury. When I was hurt, I was unsure who to speak to, as I'm quite young and typically "let things go." After a few recommendations and the first phone call I knew I was in good hands. I don't know where I'd be right now if I didn't make that simple first phone call. A thank you just isn't enough, but thank you so so much for what your firm does." Anonymous
